Associate Austin Scarborough Presents on New York Wetlands Updates and Compliance

On June 11, 2025, Austin Scarborough joined a panel of experts as part of a digital seminar hosted by HalfMoon Education, Inc. discussing the recent changes to New York Wetlands laws and compliance. The changes, beginning on January 1, 2025 significantly changed how wetlands are regulated throughout New York State. Some of these changes include the introduction of “wetlands of unusual importance,” a series of 11 criteria that may grant the New York State Department of Environmental Conservation (NYSDEC) jurisdiction over a wetland, regardless of whether or not it meets the traditional acreage threshold. Austin also discussed changes to the wetland delineation and the jurisdictional determination processes.
